No doubt you’ve heard the adage: a picture is worth a thousand words. A picture of 62-year-old Nick Christie could be worth thousands of dollars when a jury sees it.

The photo shows the Ohio man restrained inside the Lee County Jail with his body covered in pepper spray.  

“This photo is a picture of a man who is strapped to a chair naked inside a jail for hours with a hood over his face. That evokes thoughts of being tortured,” says Cleveland-based lawyer Nick DiCello who represents the Christie family.

The photo, which was obtained by FOX 13’s investigative unit, was taken in the final hours of Christie’s life.

The District 21 Medical Examiner ruled his death was a homicide because he had been restrained and sprayed with pepper sprayed by law enforcement officers. But to this day, nobody has ever been charged with a crime, and the Lee County State Attorney cleared the sheriff’s office of any wrong doing.

It’s been more than two and a half years and his wife still can’t accept what happened.

“I was shocked. This was something out of a horror movie,” says Joyce Christie. She said her husband was depressed and was showing signs of erratic behavior a few days before leaving for Florida.

She called authorities and pleaded with them to take her husband to a hospital and be given his medications. Instead, he was taken to jail for disorderly intoxication.

Her lawsuit alleges he was pepper sprayed 10 times over a 48-hour period, at times while in a restraint chair.

Tom DePolis spent more than 30 years in law enforcement at the Tampa Police Department and Hillsborough County Sheriff’s Office. He’s seen first-hand the effects of pepper spray and knows its limitations. He can see no reason for deputies to repeatedly pepper spray Nick Christie since he was already in custody.

“The purpose is to temporarily incapacitate someone — temporarily, that’s the key word, so you can restrain them,” says DePolis.

Monshay Gibbs was a deputy trainee at the jail at the time. In a video deposition, she testified that she thought the way Nick Christie was treated was excessive.

“He had a spit mask on and was naked,” she said on the video while under oath. Gibbs testified that Christie pleaded with guards to take off the spit mask because he couldn’t breathe.

He later died at the hospital. His heart failed from the shock of the pepper spray. The Lee County Sheriffs Office declined to comment on our story because of Joyce Christie’s wrongful death lawsuit, which is scheduled for trial the middle of next year.

  3. Talk about a bunch of cops going down for murder and the other ones involved for accessory to murder, simple as that. Isn`t that how it works for any one else? Every one involved should be in prison for life – this is obviously not the first time that they have done this.

I would say, if they were never trained in the actions that they took and if they didn’t seek advice from a higher up on proper procedure, then they (the individual officers, not the department) would have to be guilty of a personal offense against this man… possibly first degree murder because they, of all people should have know what their actions would lead to (i.e the man’s death). I’m tired of the departments taking all of the blame and the officers getting simple slaps on the wrist. The family of this man need to file civil suits against the officers who were involved.

The dept.s always seem to have made up excuses for their cops and it is time the cops to pay for these actions as well as the police dept.s also, and I mean to pay dearly for their criminal behavior and cover ups damn it! They have been getting away with this kind of crap for far far too long.

  7. Good provocation to ratchet up the violence between citizens and government right there. Really excellent, excellent well thought through emotive provocation. Hollywood couldn’t have done a better job trying to get citizens to start wholesale cop-killing. And that’s what all those shiny new apc’s and billion rounds of dhs bullets are for. The stage AFTER the cop-killing stage. The “justified reaction” by government “just doing their jobs”. Somebody is working very hard to make this happen in the US. Somebody stands to benefit.

    1. With the way cops have been acting lately, it seems as if they are trying to provoke the public into a fight. I can only think the reason is to have an excuse to clamp down with marshal law (early). That way they could still have a large portion of the public ok with it.

          1. I will henceforth refer to myself as ‘Patriot Joe’. My Dad was an Officer in the U.S. Army during WWII and Korea. I’ve never served in the Military but admire those who do, even when they don’t realize they are serving the enemy. Hoping they wake up before its too late.

  10. Why do all police departments now dress like storm troopers all the time? It affects attitude. Our local sheriffs and troopers wear sharp pleated shirts and trousers and low quarters, not Battle Dress and jack boots. I can’t remember a cop brutality case. Worst police “costumes” I’ve seen in the press are those Gestapo copy cat NJ highway patrols, My God! Jodhpurs,Riding boots and peaked hats? They Don’t look like PATTON, if that is what they are tryinh for.

However police brutality goes on many times a day every day in the US. Never underestimate or believe the police reguardless of what they say.

  12. this is disgusting treatment of a human being , and to the person who said the wife is some what to blame open your eyes,1 the man was in need of medical attention they were told and did nothing or nearly nothing except ask why he spat at an officer why he removed his dressing , the guy was distraught these officers sprayed pepper spray whilst his head was being held , that is assault right there , if a civvy did that to anyone and the person died they would be charged with murder, i have always wanted to come to america but with all i have seen of law enforcement officers through several sites there is no way i will vist ever
