Prosecutors seek to stop NJ Weedman’s jury nullification argument

TRENTON — Mercer County prosecutors have filed a motion to bar Edward “NJ Weedman” Forchion from discussing the testimony and evidence of his other, ongoing cases when he goes to trial for witness tampering this month.

At a status conference hearing Wednesday, assistant prosecutors John Boyle and Stephanie Katz argued that Forchion should not be allowed to discuss evidence and testimony related to the charges that stem from the April 2016 raid on his shuttered restaurant.  

Prosecutors also argued that Forchion should not be allowed to discuss jury nullification or argue that he has been charged as a “mistake of law” during the trial.

“How am I supposed to do anything, how am I supposed to defend myself?,” Forchion asked in a phone interview with NJ Advance Media Wednesday evening.

Jury selection for the witness tampering case is scheduled to start Oct. 17, and if convicted Forchion faces up to 20 years in state prison.

The marijuana activist also withdrew his motion to have Mercer County Superior Court Judge Anthony Massi recuse himself from the case, citing bias and conflict of interest in a letter to the court.

Forchion ultimately decided to withdraw the motion in order to avoid further delays.

“All I want to do is have a fair trial,” Forchion said.

Massi is expected to make a decision on the prosecution barring motion next week.

    He’s not supposed to be able to defend himself. That’s the whole point.

    “All I want to do is have a fair trial,” Forchion said.

    He won’t find a fair trial in an admiralty court.
    I wonder if anyone’s told him he’s in the wrong court. He probably doesn’t even know.

    take notice of the Bundy trials, and trials, and trials..until the false courts get what they want

    theres only 1 thing they understand, and until that comes, we will be subjugated to death and imprisoned on BS charges
