Cylvia Hayes suing Oregonian in email-blocking effort

SALEM, Ore. (KOIN 6) — Cylvia Hayes is suing The Oregonian in an attempt to block the release of potentially incriminating emails, the paper confirmed Thursday.

The Oregonian first reported Hayes, the fiancée of the recently resigned Gov. John Kitzhaber and subject of a multi-faceted and slow-burning scandal involving her relationship with the governor, is claiming her constitutional Fifth Amendment right against self-incrimination.  

In court documents filed in Marion County Circuit Court Wednesday afternoon, Hayes’ attorney, Whitney Boise, repeatedly contends the former Oregon first lady was a private citizen during Kitzhaber’s time in the governor’s office.

Phrases like “not a ‘public body,’” “not a ‘public official’,” and “a reasonable expectation of privacy” can be seen throughout the documents, and highlight Hayes’ often murky standing as both first lady and lobbyist.

Of note, Boise said that while Hayes did ask for a state of Oregon email address, she was denied, suggesting she was not seen in an official government capacity. Boise states further that if the court finds Hayes’ emails should be made public, ample time should be given to Hayes before their forced turnover.

The suit against The Oregonian comes after Oregon Attorney General Ellen Rosenblum weighed in on the matter of Hayes’ role within Kitzhaber’s inner circle, supporting the newspaper’s call for transparency.

After reviewing the court documents, Ben Gaskins, assistant professor of Political Science at Lewis & Clark College, said Thursday that while Hayes certainly has a case, he believes there’s already too much evidence against her for a judge to rule in her favor.

“I doubt very much the Fifth Amendment defense will hold water,” Gaskins said.

  2. Got to love how these commies wiggle and slither.
    She was using the state house for her own ends and now is suing because she is a ‘private person’ and was ‘defamed’.
    This (4letters with a c) needs a 12ga upside the face. Not the round but the actual gun. Take the barrel and swing the stock right into her (same word as before) face.
