Elizabeth Daly went to jail over a case of bottled water.

According to the Charlottesville Daily Progress, shortly after 10 p.m. April 11, the University of Virginia student bought ice cream, cookie dough and a carton of LaCroix sparkling water from the Harris Teeter grocery store at the popular Barracks Road Shopping Center. In the parking lot, a half-dozen men and a woman approached her car, flashing some kind of badges. One jumped on the hood. Another drew a gun. Others started trying to break the windows.  

Daly understandably panicked. With her roommate in the passenger seat yelling “Go, go, go!” Daly drove off, hoping to reach the nearest police station. The women dialed 911. Then a vehicle with lights and sirens pulled them over, and the situation clarified: The people who had swarmed Daly’s vehicle were plainclothes agents of the Virginia Department of Alcoholic Beverage Control. The agents had thought the sparkling water was a 12-pack of beer.

Did the ABC’s enforcers apologize? Not in the slightest. They charged Daly with three felonies: two for assaulting an officer (her vehicle had grazed two agents; neither was hurt) and one for eluding the police. Last week, the commonwealth’s attorney dropped the charges.

The agents’ excessive display of force is outrageously disproportionate to the offense they mistakenly thought they witnessed: an underage purchase of alcohol. But in a sense, Daly got off easy. A couple of weeks after her ordeal, a 61-year-old man in Tennessee was killed when the police executed a drug raid on the wrong house. A few weeks later, in another wrong-house raid, police officers killed a dog belonging to an Army veteran. They are, however, part and parcel of two broader phenomena. One is the militarization of domestic law enforcement. In recent years, police departments have widely adopted military tactics, military equipment (armored personnel carriers, flash-bang grenades) — and, sometimes, the mindset of military conquerors rather than domestic peacekeepers.

The other phenomenon is the increasing degree to which civilians are subject to criminal prosecution for noncriminal acts, including exercising the constitutionally protected right to free speech.

Last week, A.J. Marin was arrested in Harrisburg, Pa., for writing in chalk on the sidewalk. Marin was participating in a health care demonstration outside Gov. Tom Corbett’s residence when he wrote, “Governor Corbett has health insurance, we should too.” Authorities charged Marin with writing “a derogatory remark about the governor on the sidewalk.” The horror.

This follows the case of Jeff Olson, who chalked messages such as “Stop big banks” outside branches of Bank of America last year. Law professor Jonathan Turley reports that prosecutors brought 13 vandalism charges against him. Moreover, the judge in the case recently prohibited Olson’s attorney from “mentioning the First Amendment, free speech,” or anything like them during the trial.

In May, a Texas woman was arrested for asking to see a warrant for the arrest of her 11-year-old son. “She spent the night in jail while her son was left at home,” reports Fox34 News. The son never was arrested. Also in Texas, Justin Carter has spent months in jail — and faces eight years more — for making an admittedly atrocious joke about shooting up a school in an online chat. Though he was plainly kidding, authorities charged him with making a terrorist threat.

Federal prosecutors also recently used an anti-terrorism measure to seize almost $70,000 from the owners of a Maryland dairy. Randy and Karen Sowers had made several bank deposits of just under $10,000 to avoid the headache of filing federal reports required for sums over that amount. The feds charged them with unlawful “structuring.” Last week, they settled the case. Authorities kept half their money to teach them a lesson.

“I broke the law yesterday,” writes George Mason economics professor Alex Tabarrok, “and I probably will break the law tomorrow. Don’t mistake me, I have done nothing wrong. I don’t even know what laws I have broken. … It’s hard for anyone to live today without breaking the law. Doubt me? Have you ever thrown out some junk mail that … was addressed to someone else? That’s a violation of federal law punishable by up to five years in prison.” Tabarrok notes that lawyer Harvey Silverglate thinks the typical American commits “Three Felonies a Day” — the title of Silverglate’s book on the subject.

As The Wall Street Journal has reported, lawmakers in Washington have greatly eroded the notion of mens rea — the principle that you need criminal intent in order to commit a crime. Thanks to a proliferating number of obscure offenses, Americans now resemble the condemned souls in Jonathan Edwards’ “Sinners in the Hands of an Angry God” — spared from perdition only by the temporary forbearance of those who sit in judgment.

“What once might have been considered simply a mistake,” The Journal explains, is now “punishable by jail time.” And as 20-year-old Elizabeth Daly has now learned, you can go to jail even when the person making the mistake wasn’t you.

  1. It is truly frightening how police forces are acting this day and age.

    In the UK, they smear people when they get it wrong, when counter terrorism officers murdered an innocent electrician on the London underground, they “leaked” that he was once a suspect in a rape trial, that he was acting suspiciously, he was carrying a backpack and refused to be subdued which were all proven later on to be total fabrications. What the public are not aware of despite an innocent man dying, every officer was given a secret pay award, promoted and one Cressida Dick, seen as a fairly obnoxious and corrupt officer is likely to become commissioner in the future.

    In the news it has been revealed that a murdered black teenagers family and friends were subject of smear campaigns and continual invasive surveillance because the family had proven the police had acted criminally and in a racist manner, the current commissioners thoughts is an apology to the family who were denied justice for decades is enough.

    Go back a few years to Forest Gate, an anonymous tip off saw armed police raid at 4am a Muslim mans property, he came down the stairs in his pyjamas clearly unarmed and was shot in the chest, public anger was boiling over and the Metropolitan police’s answer was to smear the innocent man by claiming his computers they had seized had large amounts of child pornography on it, another lie to cover up police brutality.

    We could mention the Hackney man who with a recently repaired table leg covered in a bag was shot without warning by the police, we could go back further to Blair Peach where a police officer clubbed him to death at a demonstration and because the police refused totally to cooperate with the murder investigation, a killer was allowed to remain free and at large.

    The most curious of late events is that of the singer Smiley Culture, who apparently after making everyone a cup of tea during an unwarranted raid, wandered into the kitchen and stabbed himself in the chest, with only the police’s word that this bizarre action happened.

    The link to all of this is the IPCC which is an alleged watchdog supposed to bring in public oversight and prosecute the police when criminal prosecution is necessary, some 32 “classic case” murders in twenty years have been completely whitewashed because the IPCC is staffed by former police and virtually every one of them are Freemasons, the police whilst not allowed to belong to the BNP or EDL are exempt from declaring their own Freemasonry and thus we start to see corruption at every level.

    Not all British “coppers” are bent or gone bad but we are seeing more and more of the “thug” types, the shaven headed, pumped muscles, aggressive and eager for a fight on our streets, we are supposed to be policed by consent and that consent can be withdrawn especially when we don’t consent to being beaten to a pulp as a woman in the cells did in Wales (police officer was sacked but reinstated against the forces wishes by the IPCC) or the old black woman in Brixton who was so frightened by the police she died of a heart attack the same week another black man was viciously beaten to death in Brixton cells, the result was total uprising by the whole black community and it frightened Margaret Thatcher so badly she forced legislation through to rein in the police.

    There is a growing movement too here that police killers should face the death penalty but when a journalist asked the question, what then of those the police illegally kill, he was removed from the press conference.

    The point here is thus, and this is reinforced if I remember rightly by your supreme court, is that a police officer acting illegally, acting in a manner that can be seen as life threatening, you have the base legal right of self defence and I suspect this is really what is behind the gun control and removal laws because the police and government do not want people able to defend themselves…

    Comply or Die is their doctrine.

That’s not hard, really even if Bessy was zionist, Bessy doesn’t matter, while Bessy might even “vote for a zionist” (which is why voting is supposed to be TRANSPARENT and your PAPER ballot SECRET –so you can not tell how someone votes–something electronics in elections don’t allow for), but she can’t ban firearms, or send assistance money to Israel all on her own. Bessy doesn’t hold office. Bessy doesn’t run a bank. Bessy isn’t providing electronic security for XYZ Meanwhile Feinstein….Schoomer..

      You don’t need to so much filter out one Jew from another, as filter on bad activities. (really bad activity can be applied to anyone eh?)

      Maybe I am not looking hard enough? But these things stick out like a red flag to me. all without getting into a race argument. The zionists hold important high offices, and positions.

      They’ve done their homework, got their positions and we haven’t. They are strategically, and logistically positioned, we the people aren’t.

It must also be mentioned the criminal zionists/ oligarchs have achieved much of their success through robbery, murder (assassination), terrorism, propaganda (misinformation), ‘social engineering’ (manchurian candidates appointed to political office) and mayhem in general. Much more than ‘social networking’ at work here.

    What is equally disturbing and terrifying is that when it comes to accountability of the government the pendulum has swung the other way. Government has granted itself and its cronies more and more “latitude” and “flexibility” to stray further and further from the rule of law. All in the name of “protecting our liberties and safety”. Naturally nothing could be further from the truth. Today the notion that the government is operating outside the rule of law and is therefore immune from prosecution is a well established (by them courtesy of the media) reality.

    What this means of course is that we are no longer a Constitutional Republic. We are instead a third world country in the making.
