Federal lawsuit accuses Texas cop of choking milk-throwing student

The family of a Robstown Independent School District student has filed a federal lawsuit against the Robstown Police Department, the school district, and the city of Robstown, after one of its officers allegedly choked the student to the point of passing out.

The student’s offense?  He was throwing milk in his school’s cafeteria, the suit says.

At the time of the February 2012 incident, the male student, whose is unnamed in the suit, was enrolled at Ortiz Intermediate School.  

The lawsuit accuses Robstown officer Ernie Martinez of choking the boy.

In the suit, the child’s mother claims that in the two years since the incident, the child is still complaining of neck pain. Documents state that the student was suspended for the milk-throwing incident and Martinez was suspended by his department.

Pope is suing for punitive damages for civil rights violations, excessive force, infliction of emotional distress and assault related to the choking.

The Robstown Police Department and the City of Robstown didn’t respond immediately to requests for comment on Thursday.

Last year, another Robstown officer also came under fire over a video of him allegedly choking a Robstown High School student while attempting to break up an argument between the student and another child. That officer was cleared of wrongdoing after an internal investigation.

Robstown is located just outside Corpus Christi.

  1. yep — you’re absolutely right, Farmer. One big problem we have is that no one beats the crap out of cops anymore, and my parents wouldn’t have put up with this either.

    But of course, the cops would never have arrived to address this when we were in school. I used to throw milk containers at people all the time when I was in high school. I probably threw more milk containers than snowballs.
