A 14 year old was killed in a shootout with a 43 year old man, Virgis Canteen, who said he was defending himself. The 14 year old, identified as Davion Smith was a convicted felon, having been convicted for charges of armed robbery, burglary and battery. He was also a confirmed gang member.

According to The Orlando Sentinel the incident occurred in courtyard of an apartment complex,

At 7:49 p.m., Smith and two unidentified companions began taunting Canteen in the courtyard outside his Oregon Avenue apartment before the teen drew an handgun, a witness told police.

Canteen also had a handgun and, according to Canteen, the teen began shooting at him first, striking him several times in the “upper extremities,” police spokesman Sgt. Gary Gross said in a report.

Canteen said he returned fire, striking the teen “numerous times.”

According to Fox Tampa Bay, Canteen had accused Smith of burglarizing his apartment and harassing him in the past.

The incident is still under investigation, but if the incident happened like it is being reported, Canteen will likely be protected by Florida’s Stand Your Ground law.

This is the 117th defensive gun use we’ve documented in the state of Florida and the 1,255th defensive gun use we’ve documented overall.

  1. oh but… but …. he was just a CHILD. Just like the children crossing our southern borders. we don’t want to harm the children. (sarcasm)

  2. I wonder if this apartment dweller had a gang member tag. If so, he will need to gut him and hang the meat before it spoils, and he will need to turn in the skull to Florida Fish and Game for idiot examination.
