US drug agency unit to be investigated for wiretapping, lying about evidence sources

The US Department of Justice is investigating the Drug Enforcement Administration (DEA) for using invasive surveillance techniques, including wiretapping and logging telephone records into a database, to track Americans connected to illegal drug activity.

It comes after Reuters published a Monday report revealing that a shadowy DEA unit known as the Special Operative Division (SOD) – made up of officials from the FBI, CIA, NSA, IRS, and Department of Homeland Security – funnels information gathered by the DEA to those and other police agencies. Information from DEA wiretaps, informants, and the database of telephone records is passed on, often to investigations bearing no relevance to national security.   

According to documents viewed by Reuters, SOD federal agents are then trained to “recreate” the source of the investigation to cover up how they discovered a particular bit of information. That method, law experts say, violates an individual’s constitutional right to a fair trial because their defense attorney would be unable to examine details that could turn up evidence of biased witnesses or police malpractice.

News of the DEA’s cover-up “connects the dots” in explaining potential government abuse in connection with the indiscriminate collection of millions of phone records by the NSA, vice-chair of criminal justice at the American Bar Association, James Felman, told The Guardian.

By the sound of it, this a routine practice of using masses of information on Americans, in an erosion of constitutional protections of our citizens. This is clear evidence of things that people have been saying they are not doing. Collecting data on ordinary citizens and then concealing it officially. It is indefensible,” he said.

I don’t think that most people would believe that our government would be using these measures and using this excuse when they want to investigate heavy offenses,” Felman added. “What is upsetting is that it appears to be policy and practice to consensually conceal information that should be disclosed.”

While the documents in question were reportedly undated, a 2007 report by the Justice Department’s inspector general called the SOD “integral in the coordination of major DEA cases.” The unit, which was originally formed to bring down major cartels, is said to investigate drug crimes using the same methods the NSA uses to thwart terrorism.

For example, a former federal agent who worked with the SOD said that police would find an excuse to stop a vehicle which they had prior information on and then have drug dogs search the car. Upon making the arrest, officers would fabricate a traffic violation that permitted the initial stop in order to hide that they were acting on an SOD tip.

Other officials refused comment, saying that publicizing the methods of an investigation would compromise its integrity.

Federal law enforcement agencies lying about the source of their evidence also presents the possibility that NSA searches allowed by the secret Foreign Intelligence Surveillance Act court may have been authorized with tainted reasoning.

When questioned about the report during a Tuesday press conference, White House spokesman Jay Carney told reporters that it was his understanding “that the Department of Justice is looking at some of the issues raised in the story.”

Jerry Cox, president of the National Association of Criminal Defense Lawyers, told USA Today that the practice is inherently illegal.

When you lie about something, you are giving a parallel story. If you did it or I did it, we would be punished for perjury,” he said.

These latest reports are particularly troubling for accused persons who cannot vindicate fundamental constitutional rights without access to accurate and complete information. This puts liberty at risk of being lost without due process of law, which is an affront to the Constitution,” Cox added.

    I know what I would use if I was an oath breaking piece of crap, but even though I am not, I still know what I would use, it’s a matter of knowledge, money, parts and time/labor really.

    My (dark-side) style goes like this.

    1. acquire unlimited funding
    2. acquire top secret position with authority
    3. exploit everything and everyone (pretty much what we are seeing right now)

    There are FIOS splitters as cheap as $6.99 on ebay.
    I see 23 ports splitter from China $89.95
    I see custom work, straight from the manufacture(s) plural
    But man we have unlimited money, we want our kit in sophisticated space saving racks, not a Gordeon knot mixed with plastic $6.99 crap splices. (although a $6.99 splitter will do when you don’t have a rack)

    I’d be into your twisted pair vaults with my custom punch-down entire panel clamp to USB.

    I’d be running my OWN fiber optic transmission cables to my new database, and feed it with the COPY I make off the splitter.

    So what have I missed? Oh yeah Antennas, and Towers. Uh huh..
    Yeah I would have a Giant secure power transformer installed at the BASE of these towers next to the Vault. Then I Can add my own antennas, splice into all the others, and then transmit my COPY of these sources back out on my own Fiber Optic Cable run to my new database.

    I would hire SEO black hat’s and unknown artists to setup several “FSA” (free shit army) desirable free services, and I would hire some search engine programmers. You know “the guys” that have gone way past cp, cat, awk, sed, and grep. Something like HCUNIX but without the public exposure. I would recruit smart people who are psychopaths.

    I would infiltrate All other intelligence sources with “my people” to ensure they have my back.

    I would put up cameras and call them traffic cameras.
    I would have security that guards all my fences.

    Now I can know which kid that rang the doorbell, put sack of poop on my front porch and lit it up at 10:45 PM…

    Now I know when to raid that Co-Op, Guitar Manufacturer, Raw Milk Farmer, Health Supplement Mfg., Nightclub

    I would use existing agencies to attack websites. ICE, Domain Controls

    I would pit website against website, let them legally destroy themselves and then go after all their pieces.

    I would infiltrate the schools, the hospitals, welfare, and every government agency at every level with my treason.

    I would infiltrate the manufactures and have them dope back doors into logic. Imagine a simple logic chip But I add extra logic in the chip, also I build in an RF receiver, and a little bit of Gunpowder/or Chemical (I’ll hire a chemist too!) located internally on that chip where it can remotely DESTROY the extra logic and return the chip to normal.

    I would place Crystals in a pure vacuum copper shielded box out in space as an oscillator, power it with a few solar panels, then BEAM down microwaves and toast the crap out of people, places and things.

    I would poison your food and water, while profiting
    I would make sure the only thing you ever hear is MY NEWS.
    I would start wars where ever I want and take what I want.

    The only thing restraining me from taking over the entire Planet is my OATH to the US Constitution and love of the Bill of Rights.

    (I was being hypothetical if MY dark-side was allowed to go into full action– this is just my dark tech ideas )

    That’s funny. I may as well carry out this investigation for them, because I can do it right here. And the findings are:
    1. Everyone receiving a government paycheck is innocent of all charges, and acted within departmental guidelines.
    2. The DEA is protecting us from deadly drug dealing terrorists, including the ones who work for the DOJ.
    3. Go back to your TV, and don’t worry about the money we stole for this investigation that didn’t happen.
