As reported previously, Bush’s Super PAC’s actions are not only raising eyebrows, they are seen to some as either pushing or against the law. That is why there is now another FEC complaint filed against it.
The liberal group American Democracy Legal Fund filed the complaint thus time. They are arguing Bush is violating election law by coordinating directly with his Right to Rise Super PAC.
They said:
Mr. Bush’s motivation for failing to declare his candidacy is to skirt the prohibition on federal candidates raising soft money. By failing to declare himself a ‘candidate,’ he takes the position that he can fundraise for Right to Rise Super PAC, Inc. without violating the law. . . But as discussed in detail in the February Complaint, Mr. Bush triggered candidate status several months ago when he began traveling the country. Mr. Bush is no longer is the exploratory phase of his campaign and thus, he has violated the law by (1) failing to declare himself a candidate and register and report with the Commission, and (2) raising money for Right to Rise Super PAC, Inc., a soft money entity.
Bush’s spokeswoman aka damage control advocate responded to the complaint with the following statement:
Governor Bush is not a candidate for office. We are taking a conservative approach and fully complying with the law in all activities Governor Bush is engaging in on the political front and will continue to do so.
What is comes down to is: we all know he is running for office and to be fair, he should declare it.
