The Equal Employment Opportunity Commission, among its other functions, decides “hostile work environment” harassment claims brought against federal agencies. In doing so, it applies the same legal rules that courts apply to private employers, and that the EEOC follows in deciding whether to sue private employers. The EEOC has already ruled that coworkers’ wearing Confederate flag T-shirts can be punishable harassment (a decision that I think is incorrect); and, unsurprisingly, this is extending to other political speech as well. Here’s an excerpt from Shelton D. [pseudonym] v. Brennan, 2016 WL 3361228, decided by the EEOC two months ago:   Continue reading “Wearing ‘Don’t Tread on Me’ insignia could be punishable racial harassment”

Secretary of State John Kerry admitted Monday that Russia has failed to meet his Aug. 1 deadline for playing a more constructive role in Syria, and warned that he now sees Russia’s actions in Syria as “very troubling.”

Kerry warned Russia back in May that it has to help the U.S. and other allies start moving Syria toward a political transition by today. That date was still months after a United Nations-brokered cease-fire was supposed to take effect in Syria.   Continue reading “Kerry fumes after Russia ignores his Syria deadline”

On Friday, July 22, just as members of his party were gathering in Philadelphia to coronate Hillary Clinton as their presidential nominee, the Obama Administration once again released a sweeping gun control measure by executive fiat. This time the bad news came via the U.S. State Department’s Directorate of Defense Trade Controls (DDTC), which is primarily responsible for administering the Arms Export Control Act (AECA) and its implementing rules, the International Traffic in Arms Regulations (ITAR). The upshot is that DDTC is labeling commercial gunsmiths as “manufacturers” for performing relatively simple work such as threading a barrel or fabricating a small custom part for an older firearm. Under the AECA, “manufacturers” are required to register with DDTC at significant expense or risk onerous criminal penalties.    Continue reading “Just in Time for His Party’s Convention, Obama Administration Releases Latest Executive Gun Control”
