Family Sues Police In Texas For Brutality

Houston, TX – Members of a Houston family arrested by Harris County deputy constables will have a press conference later Saturday and discuss their claims of excessive force during the arrests that began with a traffic violation outside their home.

The attorney for David Scherz Jr., 26, plans to show copies of patrol car footage showing him being kicked by a deputy as another held him down. Scherz’s mother, father, sister, and an aunt were also arrested on Sept. 10, 2011 , after they came outside the home and spoke to the deputies who stopped him for running a stop sign. The felony and misdemeanor charges against the five family members were dismissed last year, after prosecutors determined there was not sufficient evidence.

Scherz, who suffered a broken rib and bruises, has brought a federal civil rights suit against Harris County and three deputy constables who arrested him after he pulled into the driveway of his home. The family has also filed complaints against the deputies with the Pct. 4 Constable Ron Hickman.
