NEW YORK — Disbarred civil rights attorney Lynne Stewart was released from a federal prison in Texas on Tuesday more than four years into a 10-year sentence after a judge ordered a compassionate release because of her terminal breast cancer.
But Stewart, who was convicted of providing material support to the terrorist Omar Abdel-Rahman by transmitting a message from him to Reuters in 2005, might have been freed long ago if she hadn’t continued to speak out after she was first sentenced.
Immediately after receiving a 28-month sentence in October 2006, Stewart stood out in front of a federal courthouse and addressed reporters. One of them asked her if she had any regrets.
“Any regrets?” she responded. “I don’t think anybody would say that going to jail for two years is something you look forward to, but as my clients have said to me, ‘I can do that standing on my head.'”
Stewart’s comment about doing the sentence standing on her head, and another in an interview with Democracy Now in which she said, “I would do it again,” inflamed a federal appeals panel. They ordered a district judge to reconsider her sentence, taking into account whether she had perjured herself on the stand in her trial and whether her statements showed that she had any remorse.
Stewart’s lawyers appealed that resentencing. Her lawyer, Herald Price Fahringer, told a three-judge panel of the 2nd Circuit Court of Appeals that “One of the most cherished policies of this nation is that everybody should be allowed to speak freely.”
“This case puts that principle to a very great test,” he said.
The Los Angeles Times editorial board put it a little more bluntly, arguingthat that Stewart didn’t deserve “8 more years for mouthing off.”
But the appeals court approved the resentencing of Stewart that it had ordered in the first place. She would likely have remained in prison until 2018, were it not for the cancer that federal lawyers estimated leave her with less than 18 months to live.

OK, there are a lot of prisoners that will never get out that have cancer and will die in prison. That traitor should die in prison and never get out of max security. She is a sellout. Hell I bet she will live another 10 + years. 👿

I think she is an incredibly brave soul…who recognizes the Fascist Nature of our government and that our government has long ago violated their commitment to “we the people”….

Hey there RJ, there are a lot of people in prison that have life threatening illness in prison. Why is she so damned priveledged to get a early realease and not others in prison. I think that she made some sneaky deal with the feds…… As for you sayin` to me thinkin` that I am in favor of the patriot act – you can go f*ck yourself eh, here is the middle finger for you. That is one of the most ridiculous statements I have heard in quite some time.

I know…that is why I said it….I was having a hard time believing that you would side with any of the currently corrupt government officials or their POV …now about Ms. Stewart…I don’t really know about her health…but I don’t think she should have been locked up either way…More Bush Tyranny…and I suppose she may have cut a deal or some such thing … but from what I know of the case…they probably don’t want her dying on their watch…where they would have to drag out her case and remind everyone how she was railroaded under TPA…..but I am gong to accept your suggestion and go in right now and see how “fu*king myself” will feel….when can I expect your removed middle finger to arrive at my home so I can experience the real thing?

Forget it RJ, I am a hot head sometimes, especially on subjects like that. No problems . I am a felon for something that I didn`t do or have any involvement in, and so therefore thery think they took my 2nd amendment rights so there for I do not believe that anything the govt. says does not apply to me or anyone else that the govt. stole there rights. Bottom line is that The govt. is no freind of mine and I am no freind of the govt. and the govt. made that very loud and clear to me and every other felon out there by taking there rights away. As to how I see it is that they held me as a prisoner of war, period, and they went out of their way to do it.
