NYPD officially fires cop who stomped on suspect’s head in Brooklyn following misdemeanor assault conviction

A NYPD cop who vowed to fight a court order to resign from the force for stomping on a suspect’s head has officially been given his walking papers, officials said Wednesday.

The NYPD terminated Police Officer Joel Edouard’s employment after a departmental trial, officials said.

Edouard, 38, was convicted of misdemeanor assault after he was caught on video stomping on Jahmi-El Cuffee’s head on Malcolm X Blvd. in Bedford-Stuyvesant in July 2014.

Had he been convicted of a felony, the 10-year NYPD veteran would have been fired immediately. Since he was convicted of a misdemeanor, the law allowed Edouard to keep his job.

Edouard, a seven-year member of the force, makes a stomping motion at Cuffee’s head after the man was subdued on Malcolm X Blvd. in Bedford-Stuyvesant. The incident was caught on video.Yet Brooklyn Supreme Court Judge Alan Marrus added an unusual condition to his sentence to two years’ probation on June 23: resign from the force if Police Commissioner Bill Bratton didn’t fire him in the next 24 hours.

Edouard’s attorney Anthony Ricco lambasted the controversial sentencing at the time, calling it an “unlawful order.”

“Court cannot impose a condition that violates an individual’s rights under the New York State constitution and the specific provisions of the Public Services Law,” Ricco said as he filed an appeal.

Attempts to reach Ricco Wednesday were unsuccessful.

  4. He should have been convicted of a felony for that head-stomp. If I did that to a guy lying on the ground while I was carrying a gun, does anyone think I’d only be convicted of a misdemeanor? But I suppose we should be glad he was convicted of anything at all.

    Of course he gets probation, the standard slap on the wrist given to any pig who, against all the odds, still manages to get convicted of a violent crime.

  5. Good thing they “Officially Fired Him”.
    Because being “Unofficially Fired” means you can still stomp on pee poles heads and steal their sht.
    At least now it’s official….so we’re safe now.
    I guess he can follow the child star actors path now of pain and death.
    Or….
    He can become the next drug dealer thug from all the connections he made stomping heads.

    What they fail to mention is that the “fine” uniformed thug “Brett Seekatz” was recorded kicking the man in the head.

    And now here he is promoted. What a crock of shit!

    No charges filed, no accountability…instead he get rewarded.
