Texas Deputy Killed in Dawn No-Knock Drug Raid

A Burleson County sheriff’s deputy leading a dawn, no-knock drug raid was shot and killed by the homeowner last Thursday. Sgt. Adam Sowders becomes the 40th person to die in US domestic drug law enforcement operations so far this year.

Although Sowders was killed early last Thursday morning, we delayed reporting the story because the sheriff’s department refused for several days to release search warrant information that would have verified it was indeed a drug-related search warrant.  

According to the Bryan-College Station Eagle, Sowders had obtained a search warrant for the residence after obtaining information that the homeowner was growing marijuana and possibly had stolen guns. The warrant was a “no-knock” warrant, meaning police could forcibly enter the residence without giving residents a chance to respond.

Sowders, the first officer through the door, was shot and killed by homeowner Henry Goedrich Magee, 28, who has now been charged with capital murder. But Magee’s attorney, famed Houston defense lawyer Dick DeGuerin, said Magee and his pregnant girlfriend were sleeping in the home when they heard “explosives” going off and loud pounding at the door. Moments later, the door burst open and a person Magee couldn’t identify entered the residence. Magee grabbed a rifle leaning against his bedroom door frame and shot Sowders. According to DeGuerin, Magee shot him because he “believed the man rushing in was an intruder and he needed to defend himself.”

Magee has a felony and a misdemeanor drug conviction, but DeGuerin said all investigators found inside the trailer were a few marijuana plants and four guns that were all legal. DeGuerin pointed at the no-knock warrant as a contributing factor in Sowder’s death.

“The danger is that if you’re sitting in your home and it’s pitch black outside and your door gets busted in without warning, what the hell are you supposed to do?” DeGuerin said.

  1. Castle laws. The guy should have no charges filed against him.
    He defended his home against an intruder.
    These SOB cops think that they can just do as they please and we have to allow it. This needs to be the new standard. If they enter your home they get shot. I bet they would re-think the home invasions they currently love to conduct.

  2. Yep , I knew this was coming , and my opinion is .. The cop got what he asked for , and if these no knock home invasions via the police state don’t stop , more cops are going to eat a bullet. You play the game you take your chances , if they don’t want to go about this in a lawful maner , more blood like this will spill . I know for sure if I thought I was protecting my family from lawless intrusion , I’d do the same thing.
    Either do it the right way or don’t do it at all
    And tell me this , what man has the right to tell another man what is legal in his own home? Not the Gestapo , not the government . Keep playing this lawless game and watch the bodies stack up
    This man should be set free , and the no knock warrent game needs to be shown as anti American and anti constitutional

  3. And they found that the guns were legal and he only had a few plants !!! Good I wish he had taken out more cops. Sounds like this guy pissed off somebody and they snitched on him or else maybe someone this guy knew got busted and they ratted him outt for lesser charges. Ya can bet on it.

  4. Houston defense lawyer Dick DeGuerin is one of the good guys. He was one of the ones who helped represent some of the Branch Davidians after the Waco Massacre. Not saying he can perfom a miracle here but the guy has a slightly better than average shot with him than without him. And who knows? Maybe juries will finally grow weary of residents getting murdered in their own homes by police in these no-knock raids and render a just verdict.

    1. Here is a case where jury nullification would be the right thing and a “not guilty “verdict rendered.I would be interested in knowing if leo was wearing body armor and what was the caliber of rifle/steel core ammo ect.

When leo’s break the law, they then become criminals in the act, and justifiable deadly force is the standard measure to be used when criminal elements break and enter into a private domicile. as bad as it may sound, if this situation were to happen with more frequency, the percentage of no-knock warrants would decline rapidly.

    To all leo’s who may read this- if you violate someone’s God given right to peace and liberty thru your illegal and unconstitutional no knock warrants, dont be surprised if you get shot at and or killed for your criminal actions.

  6. One dead pig is a good start, but we’ll need to see a lot more bacon flying before they end the “no-knock warrant” practice.

    Why was the no-knock warrant necessary? Did they think he would flush his guns down the bowl? Even one of the plants probably would have clogged the thing, so there’s absolutely no reason for busting the door down in the middle of the night.

    The pig got what he deserved, and if there’s any justice in this case, Henry Magee (the shooter) will get off scott-free for defending himself, and the county should pay for his lawyer, too.

Just abandon the war on drugs.Vices are not crimes while home invasions clearly are.Empty the prisons of non-violent drug prohibition offenders and make room for the bankers,politicians and cops who are actually breaking the law.If pot smokers could grow all the plants they wanted the problem would be solved overnight.Why would you grow more than you could smoke when there’s nobody to sell it to ’cause everyone else has their own free plants?The drug war is just a power grab and another reason to confiscate property,deny rights and profit from the runaway,increasingly privatized prison for profit system in the land of the free and the home of the slave.

    1. If everyone has ready access to free dope, of any sort, the price will drop as well as drug related crimes.

      The reason this will NEVER happen is the gov will lose far too much capital from their loss of demand of the product they supply.

      The army is protecting opium in Afghan – the CIA runs coke into the US & abroad – pot is smuggled into the US and confiscated drugs are often sold etc.

      The ideas are good yet not feasible because of the tyrannical Gov.

      1. You are absolutly right Cynicles. I have known a lot of drug users and old addicts – 60 + yrs old and many of them have good jobs. All their money goes for heroin/morophine, some of them there money goes for crack or meth. I call them addicts because everyone of them has been useing their drugs for atleast 20+years and with daily use. They never get into trouble and they are considered as good people by most in the comunity that they live in. They never sell drugs or steal to get them. In fact they say that it is the criminal law breakers that make most drug users look bad. Hell, a real drug addict will live a quiet, respectable looking life style to avoid being busted and ending up in jail, rehab, etc. as then they will not have access to their drugs. They are some of the nicest people and the only law they ever break is that they are drug addicts. I personally know that from first hand loong term hard use in the past.

        trouble with what they are doing is they are just playing crown employee not protecting each other bunch of wanna play sherry ifffs instead of arresting jailing the rest of the crown corporation county emplyees
        i like how they say its a new concept ppl haveing enough of those who claim power above them yep its new only a few thousand years old

  9. Serves the bastard right for not following the Constitution and Bill of Rights. Announce yourself and show the warrant or face the penalty. If you did your job right, you might have survived.
