Janet Napolitano Sues Trump Over Termination Of DACA

Former Obama Homeland Security Secretary Janet Napolitano sued the Trump administration on Friday over its decision to phase out the Deferred Action on Childhood Arrivals program.

Napolitano, who created the DACA program, initiated the suit in her capacity as president of the University of California.  

“We really support our DACA students and part of the reason we’re filing this lawsuit it to help protect their rights,” Napolitano said.

The university filed the lawsuit in federal court in the northern district of California and is seeking an injunction blocking the Trump administration from ending the DACA program.

The suit accuses the Trump administration of violating the Administrative Procedures Act (requiring public notice and comment) and constitutional due process of law requirements by ending the program. However, Napolitano did not follow the APA when she implemented the program in 2012.

According to court filings, the UC system has approximately 4,000 undocumented students, “a substantial number of whom are DACA recipients.”
