California Deputy Detains Man for Video Recording Arrest, Accusing him of Possibly Plotting Murder

An Orange County sheriff’s deputy detained a man for more than 12 minutes because he was video recording her and another deputy making an arrest at a gas station.

The deputy pretended she was only looking out for the best interest of the suspect, who was getting arrested for unknown reasons.

The citizen told her he was also looking out for the suspect’s best interest, ensuring he doesn’t wind up the victim of police abuse.

Michael Schmidt said in his Youtube description that the incident took place two days after Kern County sheriff’s deputies beat David Silva to death, only to confiscate cell phone cameras from witnesses who had recorded the beating.

The deputy first demanded his identification, even though he was not doing anything that would give her reasonable suspicion that he was committing a crime.

He was, however, sitting in the driver’s seat of his car, which gives her a little more legal leeway in obtaining his identification, even though it was clear she was not doing it as a result of a traffic infraction.

“I don’t know what your intentions are, sir,” she told him. “Why are you videotaping this gentleman as he is getting arrested?

“How do I know you’re not going to post this on Youtube or somewhere public where his family is going to get hurt because of this incident?”

Schmidt asked if he was free to go, but she informed him that he was being detained, even though she couldn’t give a clear reason as to why.

“Maybe you’re here to kill this gentleman or kill one of us,” she said.

Or maybe he was just trying to prevent them from killing the suspect.

“I’ve just seen a lot of abuses by people in your organization,” he  later said. “You guys make up laws a lot of times.”

“I don’t make up laws,” she responded.

But she obviously does make up laws because she detained him illegally.

  1. i thought the supreme court had ruled this activity as legal? if that is indeed true then the police that decide on their own that the supreme court has erred should be FIRED or arrested for infringing on the rights of citizens! i am so sick of seeing these abuses. these public employees do not have the right to hassle the public just to show how big & bad they are with their little guns & tin badges. i fear this is where our country is heading & it just makes me sick. i hope the sheriff who employs that old @#$% gets her straightened out. she certainly needs straightening out. he should take her into his office & just look at her & when she opens her mouth he might say “well- i just thought i’d keep an eye on you until i’m sure you aren’t going to go out & kill someone”. then when she asks “why would you even wonder such a thing” he could reply “exactly!!!”

  2. Harassment, intimidation, held without cause, and more. He should of ask for the duty sergeant so he could implicate the whole bunch.

    1. even then he couldn not know whether the duty officer was a sane person who knew the law or not. men & women who do this are brave. this guy could have ended up in jail, or face down on the asphalt, or even DEAD! my hat is off to these folks & i am grateful for their tenacity.

    However, Dr. Schmidt has zero backbone.

    If your going to get scared and wet your pants from
    Cop Rached then film with a hidden device.

    “I’m not answering questions.” ==> Then proceeds to do so.
    “I believe so, I believe I operate under the law.” ==> hhmmm
    “You’re paid to protect me” ==> Naive as hell.
    “I want to complement you on not taking his car by the way.” ==> ???
    “I’m not alledging that you’re not doing a good job” ==> she’s doing a good job?

    Getting palsy-walsy with the jack-boot she-bear? ==> Bad Idea!
    What was Dr. Schmidt thinking?

    This guy is damn lucky. Seeing he was certainly intimidated they
    could have had a field day with him.

    I really have no room to criticize Dr. Schmidt because he does give a glimmer of hope for America.

    Even the seemingly spineless have had it and are beginning standing up for their rights.

    I’d buy Dr. Schmidt a beer 🙂

    I think the freaky part of this encounter was that the cop was actually a woman. Look at that images…damn! Poor Dr. Schmidt will probably have nightmares for a week.

    1. I have it on good authority (a woman who is a retired DA’s investigator and CHP recruit instructor) that women cops have two routes to promotion: they can either out bad-ass the male cops, or they can f**k their way up the ladder. Looks like this deputy is using the first method.

  4. I was going to say that i thought this cop was a guy till it spoke.I’m sure i would have went to jail because of blowing lunch on her.Thats like disrespect to an officer or something.

You can also bet that they will not have anything done to them that matters and they will continue their tyranny because that is business as usual! They don”t make up the laws ,they just do whatever their sick twisted ego driven minds can come up with.If there were so many good ones they would stop the bad ones but as you can see that is not the case!

    Officer, the standard for detention is that you must have a reasonable, articulable suspicion for detaining me. Since you used the word “maybe”, clearly you don’t. I’ll need your card, and please call your supervisor. I’d like to be on my way.

    Of course, that’s easy to say here. It’s easy to type it away from a thug that can arrest, best, or kill you. But even so, the photographer’s responses was awful. You have got to bring the fight to them! They beat you over the head with the law, do the same to them. On the bright side, at least he kept filming.
