Former APD cop indicted for allegedly beating man so badly his lung collapsed

A former Atlanta police officer was indicted for allegedly beating a man so badly the man's lung collapsed and he suffered three broken ribs, according to the district attorney's office.Examiner – by Kimathi Lewis

A former Atlanta police officer was indicted Wednesday for allegedly beating a man so badly that the man suffered broken ribs and a collapsed lung. And officials said the same officer was accused of another assault a year later.

Nicholas J. Dimauro was indicted for two counts of aggravated battery, aggravated assault and two counts of violation of oath by a police officer, according to the Fulton County District Attorney’s Office. Prosecutors said in 2010 Robert Wormley was returning to his home on Woods Drive in Atlanta around 3 a.m. when he was approached by Officer Dimauro.  

The officer claimed that Wormley was illegally walking on a public street, district attorney spokeswoman Marla Robinson said. As Wormley was questioned being questioned by Dimauro, he decided to run, Jones said.

But Dimauro gave chase and apprehended Wormley at the rear of a house on Hood Street, she said. The resident of that house told investigators she saw the officer strike and kick the man, who was subdued and lying on the ground, for 15 minutes, Robinson said. Officer Dimauro said he used his police-issued Asp Baton to hit Wormley, Robinson said.

“As a result of the beating, Wormley suffered abrasions to his face, cuts to the back of his head requiring five staples, three broken ribs, a broken wrist and a collapsed lung,” Robinson said.

In April 2011, the officer allegedly assaulted another resident in southwest Atlanta and as a result, he was fired by the police chief in December, Robinson said. But Dimauro was reinstated, with back pay, to his job in 2013 by the Atlanta Civil Service Board, she said. The officer then retired from the department a short time later.

Dimauro’s case will be assigned to a Fulton County Superior Court judge and scheduled for trial.

    How the hell does a person “illegally walk” on a PUBLIC street?!?

    How convenient! I hope that guy gets the living shit beat out of him resulting in a slow, painful death.
