North Carolina transgender bathroom law challenged in court

Opponents of a new North Carolina law that bars transgender people from choosing bathrooms consistent with their gender identity sued the state on Monday, arguing the measure is unconstitutional and should be blocked by a federal court.

State lawmakers passed the law last week during a one-day special session called to repeal a Charlotte city ordinance that would have allowed bathroom choice based on gender identity versus sex at birth.  

The Republican-led legislature also voted to prohibit local governments from enacting anti-discrimination protections based on sexual orientation and gender identity. The actions drew swift criticism from lesbian, gay, bisexual and transgender advocacy groups and companies including American Airlines, Apple and Google.

“By singling out LGBT people for disfavored treatment and explicitly writing discrimination against transgender people into state law, (the state) violates the most basic guarantees of equal treatment and the U.S. Constitution,” said the lawsuit, which was filed by the American Civil Liberties Union and Lambda Legal.

The plaintiffs include two transgender men and a lesbian who said North Carolina’s law makes them feel less welcome and less safe.

“It is so more than a restroom,” said Joaquin Carcano, a 27-year-old university employee who is one of the plaintiffs. “It is about dignity. It’s about respect.”

Republican lawmakers have defended the law as a common-sense response to what they described as radical overreach by the mayor and city council in Charlotte, the state’s largest city.

Republican Governor Pat McCrory, who is seeking re-election in November, signed the state measure into law on the same day it was introduced and passed by both chambers of the legislature.

The governor’s office did not immediately comment on the lawsuit on Monday.

Opponents of the law criticized legislators for allowing little public debate before passing the sweeping measure, which they said has hurt the state’s national reputation.

They noted the weeks of debate and review given to a Georgia measure that sought to strengthen legal protections for gay marriage opponents before Republican Governor Nathan Deal signaled on Monday he would veto it.

“By contrast, what happened here in North Carolina was a farce,” said Chris Brook, legal director for the ACLU of North Carolina.

    1. The mooselems were never a problem, even by notion until their countries were invaded by the United Nations corporate military that we finance and sponsor through the sweat of our brows. Same with the queers, all of this was fathered by the Zionist Jews. I think a blanket statement about a whole people is an overreach and plays right into the Zio-Jew agenda. But hey, maybe we ought to just kill all the Muslims and they can try to kill all of us at the same time and God’s chosen can wallow in the leaving.

      1. To say that the mooselems were never a problem belies the fact that the British stirred up the hornets nest long before America even started their war of occupation. They are a natural warring nation who will fight each other if no other enemies are around. It is true that the Jews are sending them into every country to gain political and sociological power over the nations, and that the queers have been fed and have grown by the same jews. But I don’t see how by claiming that they were never a problem is going to solve our current catastrophe. Our education system has brought about a change in attitude about threats to our way of life and now half the country thinks queers and mooselems buggering our children is normal and should be applauded. It will come to us slaughtering the mooslem hordes, or trying, but at the same time slaughtering the jews who have promoted this atrocity is most desired.

        1. The British did indeed invade the Middle East, as did the Germans, first on horses, as in the Knights Templar for religion and wealth, and then in tanks for resources and wealth. Yes, the mooselems are a war like people … on the other side of an ocean. I do not fear their navies.
          In their country, away from us, they were not a threat and anyone who came from there to here pre-1968 had to denounce their former citizenship, learn to read and write our language, and pass a civics test and then swear an allegiance to this country before being admitted.
          Eliminating a problem is one thing. Eliminating the cause thereof, quite another.
          And queers can cause no harm to an American national in full possession of his or her natural rights enforced as absolute law.
          We have to fix this mess, and this time we have to fix it right, Farmer Dave.

  3. Can’t we just put a porta potty outside the men and women’s bathrooms that says “Queers”.
    Then the kids can push it over and they can bath in their queer
    sht while they’re taking a dump.
    Problem solved.
