The announcement of the sudden mysterious death of Justice Scalia of the US Supreme Court monopolized the media this weekend. This is only the 2nd time in the past 60 years that an active justice has died. With only 8 members on the Court now, the Constitutional dialogue may grind to a halt for quite some time.
How the death of Justice Scalia affects us
No matter where you stand on the political scale (even if you stand off it entirely), there are some pretty major ramifications when an acting Supreme Court Justice passes away. Not all of these things are guaranteed to happen, but all are within the realm of possibility and important to note to those who were dancing on the grave of Scalia before his body was even cold.
- New cases might not be heard in the Supreme Court until Scalia’s seat has been filled, and if they are heard, they can be deadlocked with 4 against 4.
- Pending important cases may not be continued until Scalia’s seat has been filled.
- All cases in which the Court has ruled but not yet issued an opinion could become invalidated.
- Obama will undoubtedly want to replace Scalia with a left-leaning candidate
- Congress, which currently has a Republican majority, will never confirm a liberal candidate.
- The third branch of the government, the Judicial Branch, will have its hands completely tied, leaving the Executive Branch and Legislative Branch to fight it out with no one to interpret the law.
Mac Slavo of SHTFplan wrote a fine article about the derailment of the court that you’ve got to read. These are a few of the important cases pending that will be disrupted due to the death of Justice Scalia:
- labor unions
- contraceptives
- religious liberty
- Obamacare
- redistricting, affecting red state/blue state fights for dominance
- immigration
Equally worrisome to the Court grinding to a halt completely is the possibility that Obama will manage to get a replacement in there that will act to support his unconstitutional executive actions on topics such as freedom of speech, gun control, and privacy.
While I consider myself neither a Republican nor a Democrat (I refuse to endorse the rigged, partisan system) it’s obvious that the balance of power in our country hangs by a thread, and the sudden death of a Supreme Court Justice who is currently on the bench could effectively lock up the government until a replacement is sworn in. And that replacement will set the tone for the country for a very long time. Right now, the remaining Justices are evenly split based on who nominated them: 4 were nominated by Republican presidents and 4 by Democrat presidents. The Justice who is chosen to replace Scalia could change everything.
The Justice who is chosen to replace Scalia could change everything. President Obama has about 340 days remaining in office, and it’s very likely that the Republican-majority Congress will do everything possible to fight his nominations in the hopes that a Republican president is elected. The longest vacancy in the past 100 years was during Richard Nixon’s presidency and lasted 391 days.
And there are a lot of questions about Justice Scalia’s death
Let me preface this by pointing out some facts:
- Justice Scalia was 79 years old.
- He was overweight.
- He went to bed early the night before he was found dead.
- He was a smoker.
Now, obviously none of these facts preclude the possibility that he was murdered, but they do show that it isn’t an outrageous to believe he died of a heart attack. If you apply the theory of Occam’s Razor (“when you have two competing theories that make exactly the same predictions, the simpler one is the better”), natural causes are indeed the most likely scenario.
But then, you have to add up this ever-growing pile of exceptionally weird inconsistencies.
Pronounced dead over the phone? No autopsy? Already embalmed? WHAT? Things that make you go, hmmmm….right?
Let me say it again…get prepared
At the risk of preaching to the choir, beating a dead horse, and about a dozen other cliches about repeating myself, please let me encourage you to take stock of your preparations and fill in the gaps. This is the kind of thing that could tip over a huge chain of events that will affect us all.
- Audit your budget and take care of any concerns.
- Build an emergency fund.
- Get your pantry built and put back some emergency food.
- Prepare for the potential of civil unrest.
- Get armed now before it becomes more difficult.
If you’ve been thinking of getting your prepper homestead started, now is the time to focus with single-minded determination on becoming more self-reliant. If you wait until the government is cracking down or the situation is desperate, you may be in for some unpleasant surprises.
I keep ringing this warning bell not just to hear myself talk, but because I really, truly belive that freedom comes with self reliance. Each thing you are able to provide for yourself buys you just a little bit more freedom than the neighbors who are waiting for the government to save them. We’re entering the edge of a perfect storm right now, with the volatile economy, enemies abroad, and now, a government that may be unable to fully function. We are in a situation unlike any we’ve seen before, and no one can predict how things will go down. Hopefully, nothing terrible will happen, but if it does, do you want to look back and think about how you ignored the urging to ramp up your preparations? We could easily end up in a situation like that of Venezuela, where the economy has collapsed and the country is out of food.
What do you think happened in the death of Supreme Court Justice Scalia?
This is could be a turning point for our country, and not one that turns us in the direction of freedom.
Do you have any theories about this sudden (and convenient for President Obama) death? Do you feel that he died of natural causes or something more suspicious? How long do you expect it to take for a successor to be named and confirmed? How do you foresee this affecting the average person?
Did not Scalia know the things you and I know, US Corp., all people made 14th amm. slaves, American Nationals declared enemies of the state, the bankruptcy that took place many yrs. ago, Patriot Act, NDAA, and on and on.
For him having been a judge for so long, surely he had the opportunity to tell us the condition this country is in and has been in for a very long time.
James Trafficant sure took every opportunity to expose the corruption.
I do hope there was no foul play in his death.
I live fairly close to Marfa, Texas and know folks who work for the City of Marfa and their police/EMS/Fire Dept. and other locals (few of whom like “Cinderella” Guevara even among the Mexican-Americans there, who know she is as corrupt as the day is long), so hopefully I can find out more truth about this…the fact that “Cindy” wouldn’t allow an autopsy coupled with the JP being out of town at the time, leading to a conclusion that this was a set-up assassination on someone with bad health already by the criminal psychopathic elites to foster taking our guns makes me think it was an assassination, but I hope this is not true! But since Scalia was a Catholic with Jesuit ties, it makes sense he’d be too cowardly to expose the corruption he must have known exists.
just another corporate lackey getting his walking papers
BFD dig the hole! ..NEXT!
In a country of free men , this shouldn’t matter .. I guess we will see
True, but this one might actually matter, depending on the how Obama will try to get our guns, since you know that’s his main goal in his lame duck year, and how to enforce gun confiscation. Methinks the methods they use to do this will not be the typical fascist forced gun confiscation, but a plan whereby folks will turn their guns in willingly (though they may not like it)…the “turn in your guns or starve” meme (no SS, Medicare/Medicaid, unemployment, tax exemptions, SNAP/WIC, disability, Tricare, veterans benefits, jobs, college education, etc.)…you get the idea, because that really is the only way the psychos will get our guns. Period.
I still wont G.A S. they aint god , and if any one Judge wants something of mine , He needs to come and get it himself
enforcing confiscation is one thing .. it actually working is another .. ink on a page isnt scary enough for me
“… the possibility that Obama will manage to get a replacement in there that will act to support his unconstitutional executive actions on topics such as freedom of speech, gun control, and privacy.”
Possibility???
Slam dunk.
Buy more ammo. Gonna need it.
I think it means 1 less commie in our government
after all he is part of the machine that isnt doing anything about cleaning up this mess , rather just making it worse either by inaction or wrong action
No Judge, is worth me getting upset over them passing , no matter what they “Say” is their agenda .. the proof is in the outcome and as far as Im concerned they suck , and if their “suggestions” go against my BOR.. than they can go KMA
yes even the next one that gets put in place .. I’ll respect them the same .. zero
the one thing many people need to get into their heads is,, these Judges arnt here to do anything for OUR benefit .. thats all in the past
I’m with you, EotS. I just can’t get bothered about this, since the Supreme Court has proven itself to be worthless for guarding our rights. Even if its “Justices” ruled in good faith and performed their constitutional duty flawlessly, the pigs and the Deep State still wouldn’t abide by any constitutional restrictions on their conduct as determined by the Court’s rulings.
This all goes back to the fundamental problem with the US Bill of Rights and the Constitution as a whole: It lacks any organized ENFORCEMENT mechanism.
we’re on the same page boss
“This all goes back to the fundamental problem with the US Bill of Rights and the Constitution as a whole: It lacks any organized ENFORCEMENT mechanism.”
Actually you are wrong.
The US Constitution requires the Militia of the several states to enforce both it and each state constitution, which is NOT any governmental agency but the people themselves trained as the congress requires the military to be trained and knowledgeable about the US Constitution. It does this early within the US Constitution in Article 1, Section 8, Clause 15: “To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel invasions”.
It is important to remember that the US Constitution and all that follows it is the supreme LAW of our land; that each state’s Constitution is the highest LAW of the state. That both those that serve within the general (federal) gov and state gov are required to use the Militia and by that edict forbidden to use any other governmental agency to do those duties – enforcing the laws, repelling invasions of our borders, etc.
Veterans are under attack because of that basic fact (my opinion, but backed by facts). They are trained as congress requires the military to be trained, no longer serve within our government, and should (many don’t) know the US Constitution and the state – they live in – Constitution.
Tench Coxe: “Who are the militia? are they not ourselves. Is it feared, then, that we shall turn our arms each man against his own bosom. Congress have no power to disarm the militia. THEIR SWORDS, AND EVERY OTHER TERRIBLE IMPLEMENT OF THE SOLDIER, IS THE BIRTH-RIGHT OF AN AMERICAN…The unlimited power of the sword is NOT IN THE HANDS OF EITHER THE FEDERAL OR STATE GOVERNMENTS BUT, where I trust in God it will ever remain, IN THE HANDS OF THE PEOPLE.”
See how far we have gone off base expecting those who serve within our government to behave themselves?
“It is important to remember that the US Constitution and all that follows it is the supreme LAW of our land; that each state’s Constitution is the highest LAW of the state.”
So,… you’re saying that the Bill of Rights is immaterial?
Hi Cal,
I didn’t express myself very precisely. I completely agree that a militia of the people was INTENDED to be the mechanism by which the Constitution was enforced. However, it obviously hasn’t worked out that way. Government at all levels in the US — federal, state, and local — egregiously violates the Constitution each and every day. No one is doing a thing about it. The question is: why not?
One thing we can see is that “law enforcement” and the federal standing armies are large, well-equipped, and organized. These organizations exist to ensure that statute laws and the orders of government officials — constitutional or not — are followed by the public.
In contrast, there exists no meaningful organization dedicated to enforcement of the Constitution. This is in spite of the oath taken by all government troops — an oath that obviously very few people adhere to, and which really amounts to nothing more than a formality.
There are no penalties prescribed in the Constitution for attempting to pass laws that subvert the Bill of Rights. This leaves us in the odd position of “all or nothing” — i.e., either there’s a full-blown revolution to save the Constitution, or everyone simply continues onward as before. Since very few people at any given time want to start a revolution over “just one more” unconstitutional law, incrementalism has led us to where we are today.
Laws are nothing but impotent words on paper unless someone is willing and able to enforce them. That goes for the Constitution as well. So long as we have plenty of “law enforcement” but no real “Constitution enforcement,” the former is ALWAYS going to defeat the latter whenever there’s a conflict between them.
