An amended version of Florida’s controversial ‘stand your ground’ law, which shifts the burden of proof from the defendant to the prosecutor in self-defense cases, has been ruled unconstitutional by a state judge.

In a 14-page ruling Monday, Miami-Dade Circuit Judge Milton Hirsch ruled that the changes lawmakers made to the original self-defense law were “procedural,” meaning, only the state Supreme Court has the authority to craft alterations under the state’s constitution.   Continue reading “Florida’s amended ‘Stand Your Ground’ law ruled unconstitutional”

In 1992 Fran and Dan Keller were convicted despite the absence of any evidence of raping a 3-year old, a crime that never occurred. Among the absurd charges was the transport of children to Mexico to be raped by military officials. The Kellers spent 21 years in prison before finally being exonerated by a conviction integrity unit that found no credible evidence for the conviction.

This kind of ridiculous conviction plagued child care providers during the 1980s and into the 1990s. The Amirault family who operated the Fells Acres Day Care Center in Massachusetts were ruined. The Massachusetts supreme court judge who kept the Amiraults in prison despite the completely obvious fabricated case is today a Harvard University law professor. In Wenatchee, Washington, scores of people were ruined by insane allegations of a church practicing Satanic Sex Rituals on children. There was the Little Rascals Day Care case in North Carolina, the McMartin child care case in California, and many others. Few remember that President Bill Clinton’s attorney general, Janet Reno, rose to name recognition based on false convictions from child abuse witch hunts.  Continue reading “The US Criminal “Justice System” is Devoid of Justice”

On Sunday, New York County District Attorney Cy Vance suggested Republican efforts to pass national reciprocity for concealed permit holders helps the Islamic State.

Speaking about Rep. Richard Hudson’s (R-NC) national reciprocity legislation–HR 38–Vance said, “this bill is supported, I’m sure, by ISIS.”

Vance said these things during an interview on AM 970 and the The Hill quoted Vance, saying, “It would be completely legal for a person to bring a loaded gun or guns in New York as long as it was legal to possess them in the person’s home state. A guy from Idaho, where there’s no permitting requirement whatsoever, could carry his gun into New York city loaded, into Times Square.”   Continue reading “NY County DA: National Reciprocity Helps Islamic State”

Just when you thought air travel couldn’t get any more invasive, authoritarian and downright miserable, the Department of Homeland Security and two U.S. carriers are determined to prove you wrong.

Yesterday, Harrison Rudolph, a law fellow at the Center on Privacy & Technology at Georgetown Law, wrote a very troubling article at Slate titled, DHS Is Starting to Scan Americans’ Faces Before They Get on International Flights. Here’s some of what we learned:  Continue reading “Certain U.S. Airlines Are Testing Mandatory Facial Recognition Scans on Americans Flying Abroad”

In a world where defense budgets are astronomical and wars of occupation and destabilization never end, political leaders in the UK and in Europe want you accept street level terror as the new everyday normal. The attacks are unstoppable, they say, and the world must embrace this hopelessness with faith that the government is doing all it can to create a better, safer world. Run, hide, and call the authorities, for you are helpless in this reality, so they say. But who creates and sustains this reality?   Continue reading “3 Questions You’re Never Supposed To Ask After A Terrorist Attack”

It’s not just the FBI that can’t seem to turn in its privacy-related paperwork on time. The FBI has pushed forward with its biometric database rollout — despite the database being inaccurate, heavily-populated with non-criminals, and without the statutorily-required Privacy Impact Assessment that’s supposed to accompany it. As of 2014, it hadn’t produced this PIA, one it had promised in 2012. And one that applied to a system that had been in the works since 2008.   Continue reading “DEA Deploying Powerful Spyware Without Required Privacy Impact Assessments”

SHTF Plan – by Mac Slavo

People who support gun control often argue that it would be disastrous if everyone was walking around with a gun at all times. They fear that it would make firearm accidents more likely, and in the event that a robber or a mass shooter is on the loose, there would be a chaotic hail of gunfire from all directions.

It’s a silly argument to make, considering that even in states where there are loose gun laws, and where it is easy to obtain a concealed carry permit, only a minority of citizens carry guns at all times. But for the sake of argument, what would happen if everyone was armed in the vicinity of a violent criminal?   Continue reading “This Thug Tries To Rob A Store Where Every Customer Is Armed”

As the American Airlines plane full of passengers looked on, two law enforcement officers escorted Michael Mennella — a double amputee with no feet — down the aisle and into the airport. They told him he was under arrest for extreme intoxication. But soon enough, the officers realized Mennella was sober. He’d simply hobbled down the aisle to ask for a drink on a flight that departed Miami without the wheelchair the airline had promised him.

That’s what Mennella, a businessman traveling for work, claims in a new lawsuit that’s sure to fuel more anger at airlines for horribly mistreating their passengers.   Continue reading “American Airlines Called Cops on Double Amputee After Forgetting His Wheelchair, Lawsuit Says”

A student at James Madison Memorial High School in Madison, Wisconsin is seeking to change the name of the school, citing that President James Madison was a slave owner, a fact she says makes the school “unsafe” for black students.

Mya Berry, a senior, says the fact that President James Madison inherited slaves, along with his Montpelier plantation, from his father means her school – which, like the city of Madison, Wisconsin, is named after the fourth U.S. president – is hostile to black students, reports the Capital Times.   Continue reading “Student Petitions for School’s Name Change: Slave Owner James Madison’s Name Means Black Students ‘Unsafe’”
