House passes plan to file brief in Obama immigration action case

The House passed a resolution Thursday that sets the stage for the chamber to file a brief in a Supreme Court case where Republicans argue President Barack Obama overstepped his authority with an executive order on immigration.

The resolution passed along party lines, with 234 GOP lawmakers supporting the move over loud protests from House Democrats. On the Democratic side, 181 voted against the resolution.  

Five Republicans voted against the measure.

“I believe this is vital. This is not a question of whether or not we are for or against a certain policy….This comes down to a much more fundamental question,” said Speaker Paul Ryan (R-Wisconsin) on the House floor before the vote. “This is about the integrity of our constitution. [The] separation of powers could not be clearer.”

The amicus brief will oppose the Obama administration in U.S. v. Texas, a case in which the Supreme Court will examine if Obama acted within the bounds of the law when he announced plans to defer deportation for millions of undocumented immigrants. Paul Clement, the former solicitor general, is representing the House.

Democrats have decried the brief as a political attack on the president and have asked for the House to hold a separate vote on filing an amicus brief in support of Obama’s action.

“This is a radical procedure and a radical act. If the Republicans prevail, we could end of a roundup of a million kids who did nothing wrong, who were brought here as infants,” said California Rep. Zoe Lofgren. “When all is said and done, that is what this is about.”
