Baby returned to parents after mix-up over ‘neglect’

A Sacramento court has ruled for the return of a baby who had been forcefully taken from his parents by police and child protective services without a warrant on April 24, according to a Russian consulate spokesperson’s statement.

The five-month-old child had been temporarily taken from his family after his parents – a Californian couple – were involved in an argument with doctors over the course of his treatment following a medical check-up they took him to after he began exhibiting signs of flu.  

Sammy Nikolaev has been in protective custody since April 24, when the police and Child Protective Services (CPS) had forced their way into the Nikolaevs’ California apartment after the family took the child from the hospital without proper discharge.

The CPS claimed the boy had suffered “severe neglect” at the hands of his parents.

“After five hours of deliberation and analysis of factual information presented by both sides, the judge decided to dismiss all charges against the parents”, the Russian Consul in San Francisco, Evgeny Avdoshin, told RIA Novosti.

“In line with the verdict, the baby will remain with his parents”, he added.

Avdoshin also said that the US court has fully respected the rights of Aleksandr Nikolaev – a Russian citizen – as a parent and that everything was according to proper procedure.

Yet just a few days ago, a completely different picture of distrust and accusations was being painted.

“I was pushed against the building, smacked down,”Alex said.

“I said, ‘Am I being placed under arrest?’ He smacked me to the ground and yelled out ‘I think I got the keys to the house!’” Alex later told reporters,

“It doesn’t seem like parents have any rights whatsoever.” During the commotion in the driveway Anna had set up a camera pointing at the door. At least four police officers, who did not have a warrant, are shown on film barging into the home followed by CPS workers demanding Sammy.

“I’m going to grab your baby, and don’t resist, and don’t fight me, okay?” one policeman can be heard telling Anna.

The family’s lawyer, Joe Weinberger, had also expressed his disbelief at how anyone could barge into a home and take a child into custody over neglect once a doctor ruled that the child was not in any danger whatsoever.

However, he also admitted that the parents had not taken the proper care when, firstly, removing Sammy from the hospital without following procedure, and secondly, neglecting to tell the doctor that another professional had declared there was no threat to the child’s wellbeing.

The initial news had quickly gained widespread media coverage and public attention in both Russia and the United States.

  1. It was no “mix-up”. CPS tried to steal that baby to sell it on the adoption market. The only thing that saved that kid was the video and the media attention it got. Someone in Sacramento realized the potential for a mega lawsuit and gave up the kid in a hurry. Amazing how that works.

    i sure hope the authorities didn’t vaccinate this child while in their care like they are required to.

    now that elton john and hubby have opened the door to adoption by gay male couples the skies the limit.

    they got caught GOOD!

  4. This agenda will continue… MORE… WORSE… until there are severe consequences such as arrests, imprisonment, and CO$STLY civil penalties, for both administrative agency bureaucrats and their ‘drones’! Otherwise, the dynamic is, “Everything to gain, nothing to lose.”

    Once these assholes, on ALL levels, are subject to the loss of personal freedom, the risk being unemployable (felony conviction), and a loss of personal wealth, ONLY THEN will the ‘drone’ mentality will be sufficiently motivated to think twice about initiating such actions, and ‘just following orders’. Shit! They might even tell their superiors to go f#@k themselves and “YOU DO IT!”

  6. They didn’t follow “proper procedure” to discharge their baby from the hospital? I understand they were concerned with the slipshod care the baby was receiving, and took the baby away straight to a different hospital.

    So, is a hospital stay a form of arrest now? If you don’t follow “proper procedure” you can’t leave?

    Did the first hospital decide to contact CPS to make up for their quality of care in the first place? Good thing those parents took the kid straight to another doctor.

  7. For a healthier, wealthier, happier life, avoid doctors the same way you should avoid cops and lawyers. These motherf***ers will abuse, torture then drain you of every last dollar you and your insurance can come up with.

  8. It is wonderful that this couple has their baby back. But justice did not triumph – the only reason the kidnapping was not successful is because of the public outrage. These are times when we have to protect each other. The “law” is certainly not going to protect our rights. If the internet is censored (CISPA and other pending legislation) then we won’t be able to spread the alarm over these kinds of incidents, and the STATE will get away with it, and no one’s children will be safe. The threat of losing your kids will become one more way the government destroys dissent. I hope the parents sue everyone involved for millions. I hope the hospital that initiated these actions ends up belonging to the parents. If we don’t have the right to take our kids out of a hospital we don’t trust (with or without a “proper” discharge), then God help us. Some CPS bureaucrats, some cops, and at least one doctor need to lose their jobs over this. Period.
