In the law, it is called an admission against interest or an out-of-court statement by a party that, when uttered, is against the party’s pecuniary, proprietary, or penal interests. In politics, it is called just dumb. White House chief of staff Ronald Klain offered a doozy this week when he admitted that the announced use of the authority of the Occupational Safety and Health Administration (OSHA) for a vaccine mandate was a mere “work around” of the constitutional limit imposed on the federal government. The problem is that the thing being “worked around” is the Constitution. Courts will now be asked to ignore the admission and uphold a self-admitted evasion of constitutional protections. Colleges nationwide are continuing to crackdown on unvaccinated students, with one school issuing weekly $200 fines to those who’ve yet to get the jab.

Students who don’t abide by Quinnipiac University’s vaccine mandate will receive weekly $100 fines for the first two weeks of non-compliance, and additional $200 weekly fines going forward. In the days following the police shooting of Jacob Blake on August 23, 2020, hundreds of protestors marched in the streets of Kenosha, Wisconsin. Federal law enforcement, it turns out, collected location data on many of those protesters. The Bureau of Alcohol, Tobacco and Firearms (ATF) used a series of “geofence warrants” to force Google to hand over data on people who were in the vicinity of—but potentially as far as a football field away from—property damage incidents. These warrants, which police are increasingly using across the country, threaten the right to protest and violate the Fourth Amendment. The Los Angeles police department (LAPD) has directed its officers to collect the social media information of every civilian they interview, including individuals who are not arrested or accused of a crime, according to records shared with the Guardian.

Copies of the “field interview cards” that police complete when they question civilians reveal that LAPD officers are instructed to record a civilian’s Facebook, Instagram, Twitter and other social media accounts, alongside basic biographical information. An internal memo further shows that the police chief, Michel Moore, told employees that it was critical to collect the data for use in “investigations, arrests, and prosecutions”, and warned that supervisors would review cards to ensure they were complete. Refusing to wear a mask on an airplane is about to get really expensive. The Transportation Security Administration (TSA) announced that it was doubling civil penalties for those who refuse to comply with federal mask mandates on commercial airlines, at airports, or on certain forms of public transportation like passenger rail or intercity buses. Repeat offenders could now face fines of up to $3,000.

First time offenders will be fined $500-$1,000, up from the previous amount of $250. Second offenders will be fined $1,000-$3,000. The new TSA penalties, which are separate from the fines issued by the Federal Aviation Administration for unsafe behavior, will take effect September 10th.
