Farm to Consumer Legal Defense Fund – by Pete Kennedy
At a hearing for Gibbon dairy farmer Mike Hartmann, Sibley County District Court Judge Erica H. McDonald dismissed five of six criminal charges brought by the state against Hartmann for violations of the Minnesota food and dairy code. Two of the charges arose from evidence seized during a December 4, 2012 stop of Hartmann’s vehicle by a state trooper; the other three came from the execution of a search warrant by Minnesota Department of Agriculture (MDA) officials on January 9, 2013 at Hartmann’s farm.
The key to the dismissal of the charges was Judge McDonald granting a motion to suppress any evidence obtained during the vehicle stop by state trooper Joseph Heyman who testified that he initially stopped Hartmann’s truck because he did not see a rear license plate on the truck and the truck appeared to the state trooper to be a commercial motor vehicle that did not have the required Department of Transportation markings or number. Large biotech companies like Syngenta, Monsanto, Pioneer, Dow and BASF have long been experimenting with GMO crops and seeds in Hawaii. They have farms on Oahu, Kauai and Molokai, but they’ve never operated on Hawaii’s Big Island — and now they never will.
On Tuesday, the Hawaii County Council passed a bill, 6-3, that forbids biotech companies from operating on the Big Island and prohibits all new genetically modified organisms, or GMOs. In the aftermath of one of the strongest storms to ever strike land, the most dangerous place for children in the Philippines to be right now could very well be the evacuation centers, or living near one.
This past week, the World Health Organization (WHO) and UNICEF began an aggressive program to vaccinate more than 500,000 children with the measles and polio vaccines in the typhoon affected areas of the Philippines. A law recently passed there means when you change your car from “factory” to “modified,” they can arrest you. It will be interesting to see if this gets challenged, as I think it should; there were no drugs in this man’s car, nor in his possession. Some drivers along a busy Fort Worth street on Friday were stopped at a police roadblock and directed into a parking lot, where they were asked by federal contractors for samples of their breath, saliva and even blood.
It was part of a government research study aimed at determining the number of drunken or drug-impaired drivers.
“It just doesn’t seem right that you can be forced off the road when you’re not doing anything wrong,” said Kim Cope, who said she was on her lunch break when she was forced to pull over at the roadblock on Beach Street in North Fort Worth. Heritage hog farmer Mark Baker sued the State of Michigan when its Department of Natural Resources arbitrarily ordered him to kill his pigs in late 2011.
After two years of stalling, the state now has moved his trial from his home county to the state capital, where a panel of four appellate judges – hand-selected by the state – will hear his case.

The U.S. government has just passed a new law called: “The affordable boat act” declaring that every citizen MUST purchase a new boat, by April 2014. These “affordable” boats will cost an average of $54,000-$155,000 each. This does not include taxes, trailers, towing fees, licensing and registration fees, fuel, docking and storage fees, maintenance or repair costs.
This law has been passed, because until now, typically only wealthy and financially responsible people have been able to purchase boats. This new law ensures that every American can now have a “affordable” boat of their own, because everyone is “entitled” to a new boat. “The second time makes the shell crispy and the inside succulent,” said 43-year-old Wang Fuming, as he tipped a bowl of freshly harvested bugs, one or two of their legs still twitching, into the sizzling pan.
