The UN Small Arms Treaty

The UN Small Arms Treaty, that was signed by Obama but not ratified by the Senate, went into effect on Christmas Eve.

There is no reasonable doubt that the UN Small Arms Treaty does violate the U S Constitution, and President Obama is absolutely wrong to sign it.  

This is not a complex argument. The 2nd Amendment says: “the right of the people” – not men, or militia members; “to keepand bear” – not just to own; “arms” – not only hunting or self-defense guns; and “shall not be infringed”.

The last phrase is key. If you want to restrict gun ownership, amend the Constitution to allow it; as written, there are no restrictions.

A key point to be made here is the export/import application to the 2nd Amendment. Restricting exports doesn’t infringe on our rights to gun ownership, it restricts the rights of non-Americans, those in other countries. But restricting imports does infringe.

Reasons to be concerned about the UN Small Arms Treaty:

Article 2 states:

  • Sec. 1. “This Treaty shall apply to all conventional arms within the following: 1(h) Small arms and light weapons.” – exception in section 3 below.
  • Sec. 3. “This Treaty shall not apply to …conventional arms…that… remain under that state party’s ownership” – control of that government is exempted. There is no exemption for civilians.

Article 3 regulates the export of ammunition.

Article 4 regulates the export of parts.

Article 5 states:

  • Sec. 3. “Each State Party is encouraged to apply the provisions of this Treaty to the broadest range of conventional arms.”
  • Sec. 4. Requires all Parties to submit their “national control lists” to the Secretariat.

UN Small Arms Treaty conclusion:

The UN Small Arms Treaty is not an honest attempt to create world peace. If it applied only to larger military weapons, such as planes, warships, tanks, etc, we could reasonably give the United Nations the benefit of the doubt. But with the vague wording, as well as the inclusion of “small arms and light weapons”, and specific encouragement to “apply the provisions of this Treaty to the broadest range of conventional arms”, and, finally, the exemption for arms that “remain under that State Party’s ownership”, the only reasonable conclusion is the creation of a Police State. This Treaty restricts civilian arms sales while exempting government sales, and consolidating all control under the United Nations Secretariat.

This is a fairly transparent attempt at consolidation of power under the UN, vs individual national sovereignty.

    You are incorrect.

    Obama committed TREASON when he signed it. Big difference. No one who serves within our governments were given the power to give authority to a foreign nation, foreign entity.

    What he did was openly declare his treasonous acts (again). This time if the UN comes into the US to enforce these unlawful things under our legitimate government it is (as it really was before in the 2012 elections) an invasion of our nation, an act of war against the USA and the American people.

    That is the VERY definition of TREASON, and the acts of a traitor to the USA. “We the People” need to arrest him and his complete administration and charge them with treason, including the legislative and judicial branches. Then we need to require the death penalty.

    Look at the good side, we will get to use HONEST elections to replace those positions that run for office, and new jobs created for all the rest of the positions down to the janitors. May as well clean house and get the rest of the traitors from Bush 1 and his administration, the Clinton’s and their administration, Bush 2 and his administration. Those who are in the Pentagon, and the Federal Reserve. All are TRAITORS to the USA and the American people.

    Alexander Hamilton: “… a treaty cannot be made which alters the Constitution or which infringes any express exceptions to the power of the Constitution of the United States.”

    John Adams, 2nd US President: “You have rights antecedent to all earthly governments; rights that cannot be repealed or restrained by human laws; rights derived from the Great Legislator of the Universe”

  2. Listen up folks. Berry may have signed it, Kerry sign it BUT the senate has to approve by 2/3 for it to become official. So just chill out and wait for the Assholes to approve it, then get pissed off. READ THE CONSTITUTION.

    He signed it, so it applies to him, not the citizens of this Republic , or this country
