The Supreme Court upheld by 5-4 the usage of a sedative called midazolam in drug cocktails used for death penalties in several states. Death row inmates argued the drug failed to block pain and suffering, leading to ‘cruel and unusual’ executions.

Justice Alito delivered the court’s opinion, joined by judges Scalia, Kennedy, Thomas and Chief Justice Roberts. Commentators have missed the real significance of Justice Antonin Scalia’s dissent in the gay marriage case. He calls the decision a judicial “Putsch,” an attempt to overthrow a form of government—ours. His dissent, joined by Justice Clarence Thomas, was written “to call attention to this Court’s threat to American democracy.”

His comment about the Court using the kind of reasoning we find in a fortune cookie is a funny line. WASHINGTON — The Supreme Court ruled 5-4 on Monday that a voter-approved independent redistricting commission in Arizona is constitutional.

In response to complaints that the state legislature was engaging in partisan gerrymandering of congressional districts, Arizona voters approved an independent commission to draw district lines in a 2000 ballot initiative.
